Update on CasinoCity's Court Case
In what many thought was an end to Casino City’s losing
battle against the U.S. government to reinstate their right to
advertise their online casino, is not over yet. After being
dismissed by U.S. District Court (Middle District) regarding
their appeal to their previous dismissal, lawyers for Casino
City say they will appeal yet again because the court did not
take into consideration what the online casino company is
claiming to be a violation of its constitutional rights.
The ruling on the court’s side was that since CasinoCity
was not directly prosecuted by the government, the court could
not intervene on their behalf. However, lawyers are now
questioning whether the government has the right to threaten
prosecution, thereby not affording the quasi-prosecuted
protection from the court system. What the government did, in
effect, was debilitate the casinos right to free speech – and
to not be permitted a court case is not getting to the heart
of the matter.
In essence the appeal now is to change how the court system
handles appeals. Casino City is fighting the notion that a
court case can only be called if there is direct prosecution
on one party. But what about abuses of power, which may be
what the government is doing in some regard.
It looks like a long shot, but then again, the power of
perseverance is a strong one. According to the online casino,
the appeal must be filed in sixty days, which will be a
relatively simple process. In approximately three months from
the date of submission the court will rule yet again.
